- Overview
This document contains important information about your rights and obligations, including conditions, limitations, and exclusions that may apply to you. Lindsay Meldrum, carrying on business as Bare Laser & Skin ("Bare Laser & Skin," "we," "us," or "our"), operates the website at www.barelaserskin.ca and provides aesthetic services in London, Ontario.
By visiting the Site, booking an appointment, purchasing a product or package, enrolling in a membership, or receiving treatment, you agree to these Terms. If you do not agree, please do not use the Site or our Services. Nothing limits a right you cannot waive under Ontario consumer protection law.
2. Eligibility And Age Requirements
You represent that you are at least eighteen (18) and have capacity to enter a binding contract. Clients under eighteen may receive Services only where clinically appropriate, with valid consent and guardian involvement where required. You may not use the Site or Services for an unlawful or unauthorized purpose.
3. No Medical Advice And No Provider Relationship Online
Site content is general information, not medical advice or a substitute for an in-person assessment. Viewing the Site, submitting a form, messaging, or booking does not create a provider relationship. For an emergency call 911 or attend the nearest emergency department.
4. Nature Of Services, Candidacy, And Results
Services include laser and light-based treatments, laser hair removal, skin rejuvenation, hair loss treatments, facials, microneedling, and related skincare. Treatments are elective and cosmetic. Risks and side effects are reviewed at consultation; results vary and are not guaranteed.
5. Appointments, Deposits, Cancellations, And No Shows
Appointments may be booked online, by phone, or in person. We ask for at least 48 hours notice to cancel or reschedule. Less notice or a no-show may result in forfeiture of a deposit or a fee of up to $100. Late arrivals may require shortened or rescheduled treatment. A payment method may be charged for applicable fees and balances owed.
6. Consultations And Informed Consent
A consultation may be required before treatment. You must provide an accurate health history, disclose medications and supplements, sign treatment-specific informed consent, and follow pre- and post-treatment instructions. Failure to follow aftercare may affect results and increase risk.
7. Pricing, Payment, And Taxes
Prices are in Canadian dollars and may change. Pricing shown online is an estimate; actual pricing depends on the treatment plan, area, technology, and sessions required. Taxes are added where required. Payment is due at service unless an approved financing arrangement applies.
8. Memberships And Recurring Billing
Membership benefits and recurring billing are governed by the membership terms presented at enrollment. Charges continue until cancelled; credits and discounts are non-transferable. Cancellation may require 30 days notice. Non-waivable consumer protection rights remain in effect.
9. Packages, Prepaid Treatments, And Gift Cards
Prepaid packages must be redeemed within the stated period where an expiry is permitted by law and are specific to the purchased treatment. Gift cards do not expire except where a lawful exception applies and are not redeemable for cash except as required by law.
10. Refunds
Services are non-refundable once performed. We may, at our discretion, offer a follow-up assessment or adjustment. Unopened, unused retail products may be returned within 30 days with proof of purchase; opened skincare and clearance items are final sale. Consumer protection rights are preserved.
11. Third Party Financing
Financing programs are offered and administered by the financing provider. Approval, credit terms, interest, servicing, and data handling are determined by that provider. You remain responsible for the full cost of Services if financing is denied or not funded.
12. Products
Retail and professional skincare products may be purchased at our clinic or through linked third-party portals. Vendor purchases, shipping, fulfillment, and returns are handled under the vendor's terms. Follow manufacturer instructions and discontinue use if irritation or an adverse reaction occurs.
13. Promotions And Special Offers
Promotions and events may have their own terms, eligibility, deadlines, and limits. Promotional pricing is not retroactive and cannot be combined with other offers unless stated. Contests and giveaways are subject to their own rules and applicable Canadian law.
14. Online Booking And Account Information
Online booking and client records may be supported by a third-party platform. You agree to provide accurate, current information and protect account credentials. We may refuse, limit, or cancel bookings at our discretion.
15. Privacy And Personal Information
Personal and health information is collected, used, and disclosed under PHIPA, PIPEDA where applicable, and our Privacy Policy. Do not include detailed medical information in website forms, email, social media, or text messages. By using the Site and receiving Services, you consent as described in the Privacy Policy.
16. Photography, Media, And Testimonials
Clinical photographs may be taken for assessment, documentation, and treatment planning and form part of your client record. We will not use your photographs, video, or likeness for marketing or education without written consent. Public reviews and social content may be reposted with attribution unless you tell us otherwise.
17. Electronic Communications And SMS Program
Our text program may send appointment confirmations, reminders, aftercare follow-ups, changes, and consent-based offers. Message frequency varies and rates may apply. Reply STOP to opt out or HELP for assistance. Consent to marketing texts is not a condition of purchase or Services.
18. Accuracy Of Site Information
Site material is general information and may contain errors or omissions about services, prices, promotions, availability, or staff. We may correct information or make changes without notice and are not required to update it.
19. Intellectual Property
The Site, content, logos, photographs, treatment descriptions, layout, and design are owned by or licensed to us. You may view and print content for personal, non-commercial use, but may not reproduce, sell, republish, or exploit it without written permission.
20. User Submissions, Reviews, And Feedback
If you send comments, suggestions, reviews, contest entries, or other materials, you agree we may edit, copy, publish, translate, distribute, and use them without compensation. Submissions must not be unlawful, defamatory, misleading, or malicious.
21. Prohibited Uses
You may not use the Site to violate law or rights, harass or discriminate, submit false information, upload malicious code, collect information about others, spam, phish, scrape, or circumvent security. We may terminate access and decline Services for a breach.
22. Third Party Links, Tools, And Services
The Site relies on third-party platforms for hosting, scheduling, payment, financing, analytics, and social media. Third-party tools are provided as available and are governed by their own terms and privacy policies. We are not responsible for third-party content or dealings.
23. Disclaimer Of Warranties
To the extent permitted by law, the Site, products, and Services are provided as is and as available without express or implied warranties. This does not exclude a right that cannot be excluded under Ontario law, or liability for professional negligence, personal injury caused by negligence, or fraud.
24. Limitation Of Liability
To the fullest extent permitted by law, we and our owners, employees, contractors, agents, and service providers are not liable for indirect, incidental, special, punitive, or consequential damages arising from use of the Site or products and Services. Liability that cannot be limited under applicable law is not limited.
25. Indemnification
You agree to indemnify, defend, and hold harmless Lindsay Meldrum and our owners, employees, contractors, agents, and service providers from claims arising from your breach of these Terms, violation of law, or violation of a third party's rights.
26. Dispute Resolution
Please contact us first so we can try to resolve concerns informally. If needed, the parties agree to attempt mediation in London, Ontario before proceedings, except where urgent relief is required. Statutory and tribunal rights are preserved.
27. Governing Law And Venue
These Terms and disputes related to the Site or Services are governed by Ontario law and applicable federal laws of Canada. Subject to dispute resolution, the courts of Ontario have jurisdiction.
28. Force Majeure
We are not liable for delay or failure caused by events beyond reasonable control, including severe weather, fire, emergencies, government action, labour disputes, equipment failure, utility interruption, or cyber incidents.
29. Termination
You may terminate by ceasing to use the Site and Services. If you fail to comply, we may terminate without notice, decline further Services, and deny access. Amounts owed and obligations incurred before termination survive.
30. General Provisions And Changes
Failure to enforce a provision is not a waiver. If a provision is unenforceable, the remainder continues. These Terms, the Privacy Policy, informed consents, and membership agreements form the agreement between us. We may update these Terms by posting a revised version; continued use constitutes acceptance.
